Please read these terms and conditions carefully before booking. By making a booking and signing the online contract you agree to be bound by these terms and conditions.
1. Definitions
1.1 "Breezyee", "we", "us" or "our" means Breezyee Vans Rental Service.
1.2 "Hirer", "you" or "your" means the person or persons who enter into this hire agreement and sign the online contract.
1.3 "Vehicle" means the van or vans hired by you under this agreement.
1.4 "Rental Period" means the period from the time you collect the Vehicle until the time you return it to us.
1.5 "Authorised Driver" means any driver named on the online contract who is permitted to drive the Vehicle.
2. Insurance
2.1 Important - your insurance responsibility: Breezyee does not provide fleet insurance for the Vehicle during the Rental Period. It is your sole responsibility to ensure that the Vehicle is adequately insured for the entire Rental Period.
2.2 You must either take out a valid day insurance policy covering the Vehicle for the full Rental Period, hold valid "drive any car" insurance that specifically covers hired vehicles, or hold your own fully comprehensive motor insurance policy that covers the Vehicle for the duration of the Rental Period.
2.3 Vehicles are individually insured by Breezyee for statutory third-party requirements only. This does not provide cover for you, the Hirer, or for damage to the Vehicle.
2.4 Before collection, you must provide valid proof of insurance cover for the Vehicle, including the certificate or schedule, policy start and end dates, and confirmation that you are a named driver.
2.5 We reserve the right to refuse to release the Vehicle if you cannot provide satisfactory proof of insurance.
2.6 If you rely on a "drive any car" policy, you must provide full policy wording or a letter from your insurer confirming cover for hired vehicles.
2.7 If you provide false or misleading information about your insurance cover, your insurance will be invalid and you will be fully liable for all damage and third-party claims.
3. Hirer Liability - Damage to the Vehicle
3.1 You are fully liable for any and all damage to the Vehicle during the Rental Period, regardless of fault, unless you can prove the damage was caused solely by us or by a third party where you were not at fault and your insurance covers the loss.
3.2 You are liable for repair or replacement costs, market value if the Vehicle is a total loss, recovery and storage costs, loss of use charges, and any reduction in value following repair.
3.3 You are responsible for paying the insurance excess on any claim arising from damage to the Vehicle. The excess amount will be confirmed at booking and in the online contract.
3.4 You are liable for damage to tyres, wheels, windscreens, glass, mirrors, roof, underbody, interior, keys, aerials, and detachable items.
3.5 You are fully liable for costs arising from use of incorrect fuel.
3.6 You must return the Vehicle in the same condition as collected, fair wear and tear excepted. You are liable for professional cleaning costs if returned excessively dirty.
3.7 We may require a security deposit before collection. This may be used to cover damage, excess charges, or other amounts owed.
4. Fines, Penalties and Charges
4.1 You are fully liable for all fines, penalties, charges, and infringements during the Rental Period, including speeding, parking, congestion charges, bus lane contraventions, clamping, towing, release fees, and regulatory charges.
4.2 If we are required to nominate you for any fine or infringement, you agree to pay an administration fee in addition to the fine itself.
4.3 You must notify us immediately of any fines or penalties received during the Rental Period.
4.4 If we receive a DVLA or authority notice relating to your Rental Period, we will pass your details to the relevant authority and you will be liable for all resulting costs and administration fees.
5. Authorised Drivers
5.1 Only persons named as Authorised Drivers on the online contract may drive the Vehicle.
5.2 You must not allow the Vehicle to be driven by anyone else.
5.3 Any breach may make you liable for all costs and damages and may invalidate insurance cover.
5.4 All Authorised Drivers must hold a valid full driving licence, meet minimum age and licence history requirements, not be disqualified, and have no convictions affecting insurance cover.
6. Your Responsibilities During the Rental Period
6.1 You must comply with your insurance policy, not use the Vehicle illegally, not overload it, not use it for racing or towing without permission, not transport hazardous materials, not drive outside the UK without consent, not smoke in it, not allow animals without consent, maintain fluids and tyre pressures, not drive if unsafe, and report accidents, damage, or breakdowns immediately.
7. Accidents and Breakdowns
7.1 If the Vehicle is involved in an accident, you must obtain names and addresses of parties and witnesses, not admit liability, take photographs, report to police where required, report to your insurer, notify us immediately, and complete any accident report form we provide.
7.2 You must not authorise repairs without our prior written consent.
8. Return of the Vehicle
8.1 You must return the Vehicle to the agreed location on or before the agreed return date and time.
8.2 You are liable for late return charges.
8.3 You must return the Vehicle with the same fuel level as at collection or pay for any fuel deficiency.
8.4 We may charge additional costs caused by late return or failure to return the Vehicle.
9. Online Contract
9.1 By signing the online contract, you acknowledge that you have read, understood, and agree to these terms; accept responsibility for the Vehicle; accept liability for damage, fines, and penalties; have valid insurance; and have provided true and accurate information.
9.2 The online contract and these terms constitute the entire agreement between you and us.
9.3 No variation is effective unless agreed in writing by us.
10. Payment and Charges
10.1 You agree to pay rental charges, security deposit, insurance excess, repair or replacement costs, fines, penalties, administration fees, late return charges, cleaning charges, and any other costs arising from your use of the Vehicle.
10.2 We may deduct amounts owed from your security deposit or the card provided at booking.
10.3 You agree to pay all sums due immediately on demand.
11. Termination
11.1 We may terminate this agreement and require immediate return of the Vehicle if you breach these terms, fail to provide insurance, allow an unauthorised driver, use the Vehicle illegally, fail to pay sums due, provide false information, or if we reasonably believe the Vehicle is at risk.
11.2 Upon termination, you remain liable for all sums due.
12. Limitation of Liability
12.1 Nothing limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any matter where exclusion would be unlawful.
12.2 Subject to clause 12.1, we shall not be liable for indirect or consequential losses.
12.3 Our total liability to you shall not exceed the rental charges paid, except where prohibited by law.
13. General
13.1 Nothing affects your statutory rights as a consumer under the Consumer Rights Act 2015.
13.2 These terms are governed by the laws of England and Wales.
13.3 The courts of England and Wales have exclusive jurisdiction.
13.4 If any provision is invalid or unenforceable, the remaining provisions continue in full force.
13.5 Our failure to enforce a provision does not waive our right to enforce it.
13.6 These terms and the online contract constitute the entire agreement between you and us.
14. Acknowledgement
By signing the online contract and collecting the Vehicle, you acknowledge and agree that you have read, understood, and accept these terms; you are solely responsible for arranging valid insurance; Breezyee does not provide fleet insurance; you are fully liable for damage and repair or replacement costs; you are liable for fines, penalties, and charges; you will pay sums due on demand; and these terms are legally binding.
